Smash Magazine creates personalized digital and printed magazines based on the information, photographs and stories submitted by our customers.

2. Eligibility

By placing an order, you confirm that:

• The information you provide is accurate.
• You have the legal authority to enter into this agreement.

3. Customer Responsibilities

You agree that:

• All information submitted is accurate and complete.
• You have permission from every identifiable person appearing in any uploaded photograph.
• If photographs include children, you are the parent, legal guardian, or have obtained the necessary permission.
• You will not upload any unlawful, offensive, defamatory, violent, hateful, or inappropriate content.
• You will not upload photographs or material that infringe another person's copyright, trademark, privacy, or other legal rights.

Smash Magazine reserves the right to refuse or cancel any order containing inappropriate or unlawful content.

4. Personalized Products

Each Smash Magazine is custom-made according to the information you provide.

Because every magazine is unique:

• Designs, illustrations and layouts may vary.
• AI-generated artwork is artistic in nature and may not exactly replicate uploaded photographs.
• Minor artistic differences are normal and do not constitute defects.

5. Artificial Intelligence (AI)

Smash Magazine uses Artificial Intelligence (AI), including services provided by OpenAI, to assist in generating illustrations and creative content.

By placing an order, you acknowledge and accept that AI technology forms part of the creative production process.

6. Pricing

All prices displayed on the website are shown in the applicable currency.

Prices may change without prior notice.

Delivery charges, taxes, customs duties or import fees (where applicable) may be added during checkout or may be payable by the customer upon delivery, depending on the destination country.

7. Payment

Orders will only enter production after full payment has been successfully received.

We reserve the right to cancel unpaid orders.

8. Production Time

Production begins after:

• Full payment has been received.
• All required information and photographs have been submitted.

Estimated production times are provided as guidance only and may vary during busy periods.

9. Delivery

Delivery times are estimates only.

Smash Magazine is not responsible for delays caused by:

• Courier companies
• Customs inspections
• Weather
• Public holidays
• Incorrect delivery addresses supplied by the customer
• Events outside our reasonable control

Customers are responsible for providing accurate shipping information.

10. Order Changes

Customers may request changes before production begins.

Once production or printing has commenced, additional changes may incur extra charges or may not be possible.

11. Cancellations

Orders may be cancelled only before production has started.

Once artwork creation or printing has begun, cancellations may no longer be possible due to the personalized nature of the product.

12. Refund Policy

Because every Smash Magazine is custom-made and personalized, refunds are generally not available after production has started.

Refunds may be considered if:

• We are unable to complete your order.
• There is a manufacturing defect.
• The wrong product was delivered due to our error.

Refunds will not be provided for:

• Change of mind.
• Minor artistic differences resulting from the creative or AI-generated design process.
• Customer errors, including incorrect names, photographs, addresses or information submitted during the order process.

13. Customer Review Responsibility

Customers are responsible for carefully reviewing all information submitted before completing their order.

Smash Magazine is not responsible for errors resulting from incorrect information supplied by the customer.

14. Intellectual Property

All website content, artwork, illustrations, logos, graphics, designs and branding remain the intellectual property of Smash Magazine unless otherwise stated.

Customers may use their purchased magazine for personal use only.

Commercial reproduction, resale, modification or redistribution without written permission is prohibited.

15. Marketing Permission

We will never publish or share your personalized magazine or photographs for advertising, social media, promotional material or marketing purposes without your separate permission.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Smash Magazine shall not be liable for:

• Indirect or consequential losses.
• Loss of profits.
• Emotional distress arising from artistic interpretation.
• Delivery delays caused by third parties.
• Technical interruptions beyond our reasonable control.

Our maximum liability shall not exceed the amount paid for your order.

Nothing in these Terms limits any rights that cannot be excluded under applicable law.

17. Privacy

Your personal information is handled in accordance with our Privacy Policy.

By using our website, you acknowledge that you have read our Privacy Policy.

18. Governing Law

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
